1. Introduction

Welcome to BookMyClass ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our platform that connects students with instructors for various classes and educational activities.

By accessing or using BookMyClass, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2. Definitions

• "Student" refers to users who book and attend classes on the Platform.
• "Instructor" refers to users who create and conduct classes on the Platform.
• "Class" refers to any educational session, workshop, or activity listed on the Platform.
• "Booking" refers to a confirmed reservation for a class.
• "Platform Fee" refers to the commission charged by BookMyClass on transactions.

3. Account Registration

3.1 Eligibility: You must be at least 18 years old to create an account. If you are under 18, you may use the Platform only with the involvement of a parent or guardian.

3.2 Account Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4 Phone Verification: We use OTP-based phone verification to secure accounts. You consent to receive SMS messages for authentication purposes.

4. For Students

4.1 Booking Classes: Students can browse and book available classes through the Platform. Bookings are subject to availability and instructor confirmation.

4.2 Payment: Payment for classes must be made through the Platform using our integrated payment gateway (Razorpay). All payments are processed securely.

4.3 Cancellation Policy: Cancellation terms vary by class and instructor. Please review the specific cancellation policy before booking. Refunds, if applicable, will be processed according to the class's refund policy.

4.4 Attendance: Students are expected to attend booked classes. Repeated no-shows may result in account restrictions.

4.5 Conduct: Students must treat instructors and other participants with respect. Inappropriate behavior may result in removal from classes and/or Platform suspension.

5. For Instructors

5.1 Profile Creation: Instructors must provide accurate information about their qualifications, experience, and certifications.

5.2 Class Listings: Instructors are responsible for creating accurate class descriptions, setting appropriate pricing, and maintaining updated schedules.

5.3 Platform Fee: BookMyClass charges a platform fee of 5% on all completed bookings. This fee is automatically deducted from payouts.

5.4 Payouts: Instructors must link a valid bank account and provide PAN details for KYC verification to receive payouts. Payouts are processed via Razorpay Route.

5.5 Class Conduct: Instructors must conduct classes as scheduled and described. Cancellations should be made with appropriate notice, and students should be informed promptly.

5.6 Taxes: Instructors are solely responsible for any taxes applicable to their earnings. BookMyClass does not withhold taxes on behalf of instructors.

5.7 Insurance and Liability: Instructors are responsible for maintaining appropriate insurance coverage for their classes and activities.

6. Payments and Refunds

6.1 Payment Processing: All payments are processed through Razorpay, our secure payment gateway partner. By using the Platform, you agree to Razorpay's terms and conditions.

6.2 Pricing: All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.

6.3 Refund Policies: Refunds are subject to the specific cancellation policy of each class. Refund policies may include:

• No refund
• Full refund if cancelled 24/48/72 hours before class
• Full refund if cancelled 6/24 hours before first class (for cohorts)
• Flexible refund policy

6.4 Refund Processing: Approved refunds will be processed to the original payment method within 5-7 business days.

7. Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Attempt to bypass payment systems or platform fees
• Share login credentials or allow unauthorized account access
• Use automated systems to access the Platform without permission
• Engage in any activity that disrupts or interferes with the Platform
• Collect user data without consent
• Conduct transactions outside the Platform to avoid fees

8. Intellectual Property

8.1 Platform Content: The Platform and its original content, features, and functionality are owned by BookMyClass and are protected by copyright, trademark, and other intellectual property laws.

8.2 User Content: You retain ownership of content you post on the Platform. By posting content, you grant BookMyClass a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Platform.

8.3 Instructor Materials: Instructors retain ownership of their class materials and content. Students may not reproduce, distribute, or commercially use instructor materials without permission.

9. Disclaimers

9.1 Platform "As Is": The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

9.2 No Guarantee: We do not guarantee the quality, safety, or legality of classes listed on the Platform. We do not verify instructor credentials or qualifications.

9.3 Third-Party Services: The Platform may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

9.4 User Interactions: BookMyClass is not responsible for disputes between students and instructors. We act solely as a platform facilitating connections.

10. Limitation of Liability

To the maximum extent permitted by law, BookMyClass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Platform
• Any conduct or content of any third party on the Platform
• Unauthorized access to or alteration of your data
• Any other matter relating to the Platform

11. Indemnification

You agree to indemnify, defend, and hold harmless BookMyClass and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.

12. Termination

12.1 By You: You may terminate your account at any time by contacting us. Upon termination, you will lose access to your account and any associated data.

12.2 By Us: We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in prohibited activities.

12.3 Effect of Termination: Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
